Website Design Terms

These Website Design Terms apply exclusively to custom website design and related project work provided by Vitalcoms IT Services Inc.

1. Deposit and Payment

A 50% deposit is required before work begins.

Unless otherwise agreed in writing, the remaining balance is due before final delivery, website transfer, administrator access, or public launch.

The deposit becomes non-refundable once project work has started.

2. Scope of Work

The project includes only the services and features agreed upon in writing.

Unless otherwise stated, website design services may include planning, page layout, visual design, basic content preparation, image sourcing or placement, mobile responsiveness, and reasonable technical setup related to the agreed project.

Features or services outside the original scope may require an additional quote.

3. Revisions

Website design projects include up to 2 rounds of revisions, unless otherwise agreed in writing.

A revision round means one collected list of requested changes submitted by the customer.

Additional revisions, new features, redesigns, or work outside the original scope may require an additional charge.

4. Timeline

Estimated project completion is generally 1 to 6 weeks, depending on project complexity, customer responsiveness, approvals, and technical requirements.

Any completion date is a good-faith estimate and is not guaranteed unless confirmed in writing.

Delays in providing information, approvals, access, or other required materials may extend the project timeline.

5. Domain and Hosting

The customer is responsible for purchasing, maintaining, and renewing the domain name and hosting account.

The customer is also responsible for fees and terms imposed by hosting providers, domain registrars, payment processors, plugins, or other third-party services.

6. Third-Party Tools

The website may use WordPress, themes, plugins, fonts, stock images, software libraries, or other third-party products.

These items remain subject to their respective licenses and terms. Premium licenses, renewals, subscriptions, or third-party fees are not included unless specifically stated in writing.

7. Ownership

Until full payment is received, all drafts, layouts, configurations, and project work remain the property of Vitalcoms IT Services Inc.

After full payment, the customer becomes the owner of the completed website elements created specifically for the project.

Third-party themes, plugins, fonts, stock assets, software, open-source components, and pre-existing tools remain subject to their original licenses and are not transferred as exclusive property.

8. Access and Final Delivery

After full payment, the customer will receive administrator access or equivalent control of the completed website, where technically applicable.

Final files, website transfer, administrator credentials, and public launch may be withheld until all outstanding payments are completed.

9. Maintenance

Ongoing maintenance, updates, backups, monitoring, security services, hosting support, and future content changes are not included unless separately agreed and paid for.

After final delivery, the customer is responsible for maintaining the website unless an ongoing maintenance service is purchased.

10. Customer Responsibilities

The customer must provide accurate business information and confirm that any materials supplied for the project may legally be used.

The customer is responsible for reviewing and approving the website before launch, including names, prices, contact information, claims, policies, and other published content.

11. Cancellation

If the customer cancels the project before work begins, the deposit may be refunded.

If the customer cancels after project work has started, the deposit is non-refundable.

Any completed work exceeding the value of the deposit may be invoiced separately if previously approved by the customer.

12. Website Performance

We will make reasonable efforts to deliver a functional and professionally designed website.

We do not guarantee specific search-engine rankings, traffic, sales, revenue, customer inquiries, uninterrupted third-party services, or compatibility with every future software update.

13. Limitation of Liability

To the maximum extent permitted by law, the total liability of Vitalcoms IT Services Inc. related to a website design project will not exceed the amount paid by the customer for that project.

We are not responsible for indirect damages, lost profits, lost business opportunities, data loss, hosting outages, third-party service failures, or changes made by the customer or another provider after delivery.

14. Governing Law

These Website Design Terms are governed by the laws of the State of Florida.

Any legal action relating to the website design service shall be brought before the appropriate state or federal courts located in Orange County, Florida.
